Terms & Conditions

Welcome to Cyberstack Digital.

These Terms & Conditions ("Terms") govern the supply of products and services by Cyberstack Digital ("we", "us", "our") to our clients ("you", "your"). By purchasing any product or service from Cyberstack Digital, you agree to be bound by these Terms.

2. Our Services

Cyberstack Digital provides professional digital services including but not limited to:

Website Design
Website Development
Website Hosting
Website Maintenance
Search Engine Optimisation (SEO)
Answer Engine Optimisation (AEO)
Google Business Profile optimisation
Google Ads Management
Social Media Advertising
Website Consultancy
Technical Support

Services may be offered as fixed-price packages, subscriptions, or bespoke quotations.

3. Purchasing Our Services

Many of our products are available for immediate online purchase without the need for quotations or sales consultations.

Payment confirms your intention to proceed with the purchased service.

Following purchase, Cyberstack Digital will contact you to arrange a project kick-off meeting.

No development work will commence until the kick-off meeting has taken place.

4. Project Start

A project officially begins once:

Payment has been received in full (or an active subscription has been established where applicable); and
The project kick-off meeting has been completed.

During the kick-off meeting we will discuss:

Project goals
Branding
Website content
Required functionality
Timescales
Deployment expectations

5. Client Responsibilities

To enable us to deliver your project successfully, you agree to provide:

Website content
Logos and branding assets
Images where required
Product information (where applicable)
Contact information
Any additional material requested during development

You confirm that you own, or have permission to use, all content supplied.

Cyberstack Digital accepts no liability for copyright infringement resulting from materials supplied by the client.

6. Project Delays

Clients are expected to provide requested content within 30 days of the project kick-off meeting.

If sufficient information has not been received within this period, Cyberstack Digital reserves the right to pause the project until the required information is supplied.

Project timescales will automatically extend to reflect any delays caused by missing client information.

7. Website Development

Every project is developed specifically for the purchasing client.

Package limits (such as page counts) are clearly displayed before purchase.

Should additional functionality or pages be requested outside the purchased package, additional development charges may apply.

No work outside the agreed scope will be undertaken without client approval.

8. Revisions

Reasonable revisions are included throughout the development process to ensure the finished website meets the agreed project requirements.

Where revision requests become excessive, repetitive, or significantly alter the agreed project scope, Cyberstack Digital reserves the right to charge additional development time.

The current additional development rate is £150 per day.

Any additional charges will always be discussed and agreed before work is undertaken.

9. Website Hosting

Where hosting is provided by Cyberstack Digital:

Hosting remains under our management.
We will use reasonable efforts to maintain uptime and service availability.
Planned maintenance may occasionally require temporary service interruption.
We cannot guarantee uninterrupted service due to factors beyond our control including third-party infrastructure providers.

10. Domains

Cyberstack Digital can assist clients in registering domain names.

Unless otherwise agreed:

Domains will be registered in the client's name.
Domain registration costs remain the responsibility of the client.
We may purchase domains on your behalf through our hosting provider where requested.

11. Search Engine Optimisation

SEO services are designed to improve your website's technical quality and search visibility.

However, search engine rankings cannot be guaranteed.

Google and other search engines regularly change their algorithms and Cyberstack Digital accepts no responsibility for ranking fluctuations beyond our control.

12. Advertising Services

Where Google Ads or social media advertising services are purchased:

Advertising spend is separate from our management fees unless explicitly stated.
Clients remain responsible for platform advertising costs.
We cannot guarantee enquiries, sales, leads or return on investment.

13. Support Packages

Maintain, Optimise and Accelerate are subscription services.

Subscriptions continue on a rolling basis until cancelled.

Cancellation requires one full calendar month's notice.

Example:

If notice is provided on 10 March, one final payment will be collected before the subscription ends.

14. Intellectual Property

Upon receipt of full payment:

You own your completed website.
You retain ownership of all content supplied by you.
You own your branding, logos and media.

Cyberstack Digital retains ownership of:

Internal development tools
Proprietary code libraries
Frameworks
Automation systems
Templates
Reusable software components
Internal workflows

These components may continue to be used across future client projects.

15. AI-Assisted Development

Cyberstack Digital may utilise AI-assisted technologies during the design, development and content creation process to improve efficiency and productivity.

All code, website configurations, generated content and deliverables are reviewed, tested and approved by a human before deployment.

16. Deployment

A website is considered delivered once it has been successfully deployed to the client's agreed live domain.

Following deployment, responsibility for ongoing content changes falls to the client unless an active support package has been purchased.

17. Limitation of Liability

Cyberstack Digital shall not be liable for:

Loss of profits
Loss of business
Loss of revenue
Business interruption
Loss of data caused by third-party providers
Search engine ranking changes
Third-party software failures
Hosting outages outside our direct control

Our total liability shall never exceed the amount paid by the client for the relevant service.

18. Third-Party Services

Projects may incorporate third-party software including:

WordPress
Stripe
Google Analytics
Google Search Console
Google Ads
Meta advertising platforms
Hosting providers
Plugins
APIs

Cyberstack Digital cannot accept responsibility for outages, pricing changes, discontinued services or technical issues arising from third-party providers.
